Physicians Insurance Online Privacy Policy

Privacy is important to Physicians Insurance A Mutual Company, its subsidiaries, and Physicians Insurance Risk Retention Group, Inc. (collectively, “Physicians Insurance”, ‎“we”, “our”, and “us”‎). This online privacy policy (“Privacy Policy”) explains our data collection and use practices, and applies to any websites that we own ‎and ‎control, such as ‎the www.phyins.com website (the “Website”) and any related products and services, including any ‎‎associated interactive features, widgets, ‎plug-ins, applications, content, downloads, and other ‎‎services we may offer to you that posts a ‎link to this Privacy Policy (collectively, the ‎‎‎“Services”), regardless of how you access or use ‎them, whether via personal computer, browser, ‎‎laptop, tablet, mobile phone, or other device ‎‎(each a “Device”). 

This Privacy Policy describes how Physicians Insurance collects, uses, shares, and processes personal and other ‎information and data of users of ‎‎our ‎Services.‎ To the extent that we provide you with notice through our Services of different or ‎‎additional ‎privacy policies or practices (e.g., at the point of collection), those additional privacy ‎‎policies ‎shall govern such data collection and use. By accessing the Website, you are consenting to the information collection and use practices described in this Privacy Policy, and to our Terms of Use.

We reserve the right to change this Privacy Policy at any time, and we will post a notice or ‎‎‎inform you of any such ‎changes on our Website. To the extent that any translated versions of this Privacy ‎‎‎‎Policy conflict with the English-language version, the English-language version of this Privacy ‎‎‎‎Policy shall control.‎

  1. COLLECTION OF YOUR PERSONAL INFORMATION

We collect information from you in several ways, including when you choose to share ‎‎‎information with us by entering it through our Website and by using automated processes. ‎We ‎‎also collect information about your transactions with us, such as any information you ‎submit to ‎‎us through our Services. 

  1. Information You Provide.

We may ask you and you may choose to provide certain “Personal Information” to us, which ‎is ‎‎information that identifies you personally, such as your first and last name, email address, ‎‎‎payment information including financial account numbers, mailing and billing addresses, ‎‎‎government identification numbers, policy number, date of birth, social security number, job ‎‎‎title, marital status, employment information, telephone number, and health, medical, and other information related to your insurance application [3] or claim. Please note that we use a third-party payment ‎‎‎processor and so we do not store information about your payment card when you submit an ‎‎‎online payment. If a claim is reported to us, we may require you to provide ‎‎‎additional information, such as information about your insurance policy, including the policy ‎‎‎number, and information about the harm suffered and the circumstances, causes, reasons, and ‎‎‎events that led to the claim. 

  1. Information About Third Parties.

By submitting Personal Information about any third party, you represent and warrant to Physicians Insurance ‎‎‎that you have the consent of the third party to do so, and that the information you submit is ‎‎‎factually accurate.‎

  1. Automated Information Collection. [4] 

In addition to any information that you choose to submit to us via our Services, we and our ‎‎third-party service providers may use a variety of technologies that automatically (or passively) ‎‎store or collect certain information whenever you visit or interact with our Services (“Usage ‎‎Information”). This Usage Information may be stored or accessed using a variety of ‎‎technologies that may be downloaded to your Device whenever you visit or interact with our ‎‎Website. To the extent that we associate Usage Information with your Personal Information we ‎‎collect directly from you through our Services, we will treat it as Personal Information.‎

This Usage Information may include:  ‎

  • ‎your Internet Protocol (“IP”) address, unique device identifier (“UDID”), or other unique identifier (together, a “Device Identifier”). A Device ‎‎‎Identifier is a number that is automatically assigned to your Device used to access our ‎Services, ‎‎and our computers identify your Device by its Device Identifier;‎

  • your Internet Service Provider (ISP);

  • ‎your Device’s functionality (including browser, operating system, hardware, mobile ‎‎‎network information);‎

  • ‎the URL that referred you to our Services;‎

  • ‎the areas within our Services that you visit and your activities there, including ‎‎‎remembering you and your preferences;‎

  • ‎your Device’s location;‎

  • ‎your Device’s characteristics; and

  • ‎certain other Device data, including the time of day, among other information.‎

Tracking Technologies. We may use various methods and technologies to store or collect ‎Usage ‎‎Information (“Tracking Technologies”). Tracking Technologies may set, change, alter, ‎or ‎‎modify settings or configurations on your Device. A few of the Tracking Technologies ‎include, ‎‎without limitation, the following (and subsequent technology and methods later ‎developed):‎

  • ‎Cookies. A cookie is a data file placed on a Device when it is used to visit our Website. ‎‎‎HTML5 cookies can be programmed through HTML5 local storage.‎

  • ‎Web Beacons. Small graphic images or other web programming code called web ‎‎‎beacons (also known as “1×1 GIFs” or “clear GIFs”) may be included in our Website’s ‎pages ‎‎and messages.   • ‎ETag, or Entity Tag. This is a feature of the cache in browsers. It is an opaque identifier ‎‎‎assigned by a web server to a specific version of a resource found at a URL. If the ‎resource ‎‎content at that URL ever changes, a new and different ETag is assigned. Used ‎in this manner, ‎‎ETags are a form of Device Identifier. ETag tracking may generate ‎unique tracking values, even ‎‎where the consumer blocks HTTP and/or HTML5 cookies.‎

  • ‎Recognition Technologies. These are technologies, including the application of statistical probability ‎‎‎to data sets, which attempt to recognize or make assumptions about users and devices ‎‎(e.g., that ‎‎a user of multiple devices is the same user).‎

Tracking Technologies Usage. We may use Tracking Technologies for a variety of ‎‎‎purposes, including:‎

  • ‎Strictly Necessary. We may use cookies or other Tracking Technologies that we ‎‎‎consider strictly necessary to allow you to use and access our Services, including ‎cookies ‎‎required to prevent fraudulent activity and improve security.‎

We may use your information to process your ‎‎‎applications or payments, to defend claims, to provide loss control services, to inform underwriting, ‎‎‎and to provide you with information that may be of interest to you‎. In support of these uses, Physicians Insurance may use Personal Information to provide you with more effective customer service, to improve the Website and any related Physicians Insurance products or services, to enforce our Terms of Use, to meet our legal obligations or to inform a legal proceeding, and to make our Services easier to use by eliminating the need for you to repeatedly enter the same information. In order to offer you a more consistent experience in your interactions with Physicians Insurance, information collected by our Services may be combined with information collected by Physicians Insurance from other sources.

We may use your Personal Information to provide you with important information about the product or service that you have purchased or inquired about. Additionally, we may send you information about other Physicians Insurance products and services, and/or share information with Physicians Insurance partners so they may send you information about their products and services. We may anonymize or aggregate your ‎‎information for marketing and actuarial purposes.‎ We may merge Website-visitation data with demographic information, and we may use this information to provide more relevant content. We may combine Website-visitation data with your Personal Information in order to provide you with personalized content.

Physicians Insurance may share the information we collect from you, including Personal Information, with third parties for a variety of purposes. For example, we may share information with service ‎‎providers that assist us in our business ‎operations. ‎Physicians Insurance may also disclose Personal Information if required to do so by law; to satisfy any applicable law, regulation, subpoena, government request, or other legal process; or in the good-faith belief that such action is necessary to (a) conform to the edicts of the law or comply with legal process served on Physicians Insurance; (b) protect and defend the rights or property of Physicians Insurance; or (c) act in urgent circumstances to protect the personal safety of Physicians Insurance employees or agents, users of Physicians Insurance products or services, or members of the public.

We may also share information with third parties, including law ‎‎enforcement, to protect our Services and to enforce our Terms of Use. ‎We also reserve the right to share the information that we collect with our subsidiaries ‎‎and ‎affiliates for marketing and other business purposes, and with any subsequent owner in the ‎‎event ‎of a merger, consolidation, sale of our assets, or other change in our business, including ‎‎during ‎the course of any due-diligence process.‎ 

  1. Co-Branded Areas.

We may provide certain parts of our Services in association with third parties, such as ‎‎‎promotional partners or affiliates. These “co-branded areas” will identify the third party. If you ‎‎‎choose to use these co-branded areas, we may share your information with the identified third ‎‎‎party, and that third party may also collect information from you, in addition to the information ‎‎‎that we collect, as described above.   1. ‎Links to Third-Party Websites.‎

Our Services may include links to third-party websites or other online services. We are not ‎‎‎responsible for these other sites and services, and they may collect and use information about ‎‎‎you.   1. ‎Third-Party Tracking and Do Not Track Technology.‎

Third parties may use tracking technologies in connection with our Services, which may include ‎‎‎the collection of information about your online activities over time and across third-party ‎‎‎websites. This Privacy Policy does not apply to these third-party technologies because we may ‎‎‎not control them and we are not responsible for them. Do Not Track is a technology that enables ‎‎‎users to opt out of tracking by websites they do not visit. Currently, we do not monitor or take ‎‎‎any action with respect to Do Not Track technology. ‎

  1. ‎Analytic Services and Targeted Ads 

We use third-party analytics services, like Google Analytics, to collect, monitor, and analyze ‎‎‎data we collect through our Services to better understand how our Website is used and to ‎‎‎improve its functionality. These services may track details about your online activities over ‎‎‎time and across different websites. These services may also allow us and others to provide you ‎‎‎with targeted advertisements or other content that you may be interested in based on your online ‎‎‎activities.‎

The Google Analytics service tracks and reports website traffic and provides us insight into ‎‎‎behavior information relating to visitor age, gender, and interests. Google Analytics ‎‎‎Demographics and Interest Reporting give us insight into behavior to help us understand ‎‎‎browsing behavior and give you a better experience when you visit our Website. You can opt-‎‎‎out of Google Analytics for Display Advertising and customize Google Display Network ads ‎‎‎using the Ads Settings. ‎

These third-party services have their own privacy policies addressing how they use such ‎‎‎information. We recommend you review their privacy policies.   1. SECURITY OF YOUR PERSONAL INFORMATION

The protection of your Personal Information is important to us. Physicians Insurance uses commercially reasonable efforts and industry standard security technologies and safeguards‎ to protect your Personal Information from unauthorized access, use, or disclosure. We also expect our service providers to protect information ‎‎in the same manner.‎ However, no data transmission over the Internet, mobile networks, wireless transmission, or electronic storage of information can be 100% secure. Please note that Physicians Insurance cannot guarantee the security of any information you transmit to us. 

  1. USERS OUTSIDE OF THE UNITED STATES

If you are from a non-U.S. country, please be aware that the Personal Information you submit, ‎‎‎including information provided through our Services, is being sent to a location in the United ‎‎‎States. The data protection laws in the United States are likely different from those of the ‎‎‎country in which you are located, and your Personal Information may be subject to access ‎‎‎requests from governments, courts, or law enforcement in the United States according to laws of ‎‎‎the United States. By providing such Personal Information through the Services, you are ‎‎‎consenting to (and represent that you have authority to consent to) the transfer of such ‎‎‎information to the United States for the uses and purposes described in this Privacy Policy. ‎‎‎Without limiting the above, for the avoidance of doubt we do not have an establishment or ‎‎‎target ‎the Services or our marketing to individuals in the European Economic Area (including the EU) or the United Kingdom. ‎

  1. SOCIAL SECURITY PROTECTION POLICY STATEMENT‎ 

It is our policy to protect the confidentiality of Social Security numbers (SSNs) from misuse and improper disclosure by maintaining and enforcing ‎‎physical, ‎‎electronic, and procedural safeguards. We prohibit unlawful disclosure of SSNs, and limit access to SSNs to our personnel who need access to SSNs in order to perform their job functions. We do not disclose SSNs to third parties except where ‎‎required ‎or ‎permitted by law.‎

Our sites and applications are intended for general audiences,  and we do not knowingly seek or collect any Personal Information from children under the age of eighteen (18).   1. ACCEPTANCE OF TERMS

These terms of use (“Terms of Use”) govern your use of any websites and any interactive features, widgets, plug-ins, applications, content, downloads, and ‎other services that we may own and control and make available through any websites that we ‎own and control, that post a link to these terms of Use, including any services or any self-service platform we offer (collectively, the ‎‎“Services”), regardless of how you access or use them, whether via personal computers, mobile ‎devices or otherwise (each, a “Device”). You agree that you will not: (i) use our Services for any political or commercial purpose, aside from as permitted by the functionality of the Services or Physicians Insurance; (ii) engage in any activities through or in connection with our Services that attempt to or actually do harm to any individuals or entities or are unlawful, offensive or abusive, or that violate any right of any third party, or are otherwise objectionable to Physicians Insurance in its sole discretion; (iii) reverse engineer, decompile, disassemble, reverse assemble or modify any Services source or object code or any software or other products, services or processes accessible through any portion of our Services; (iv) engage in any activity that interferes with another user’s access to our Services or the proper operation of our Services, or otherwise causes harm to our Services, Physicians Insurance or other users; (v) use Site Content in a manner that suggests an unauthorized association with any of our products, services or brands; (vi) interfere with or circumvent any security or access feature of our Services; or (vii) otherwise violate these Terms of Use or applicable law.

  1. CREATING USER ACCOUNTS‎.

Some of the Services features may require an applicable User to register for an account through an ‎online registration process. When you register for an account, you will select login ‎credentials and you agree that you: (i) will not use a username (or e-mail address) used by ‎someone else, that impersonates another person, belongs to another person, violates the ‎intellectual property or other right of any person or entity or that is offensive; (ii) will provide ‎true, accurate, current and complete registration information about yourself and your organization during any ‎registration process and will update it as needed to keep it accurate; (iii) will immediately ‎notify us of any unauthorized use of your account, password or username, or any other ‎breach of security; and (iv) will not sell, transfer, or assign your account or any account ‎rights. You are solely responsible for all activities that occur under your account, password ‎and username whether or not you authorize the activity. You are solely responsible for ‎maintaining the confidentiality of your password and for restricting access to your device(s) ‎so that others may not access any password-protected portion of our Services using your name, ‎username, or password.   1. ONLINE SUBMISSION OF CLAIMS

You may be able to submit online claims for insurance benefits under an existing Physicians ‎‎Insurance Policy. If you submit an online claim, you agree that you will not submit any ‎‎information that you know to be, or have reason to believe to be, false, fraudulent, deceptive, ‎‎inaccurate, misleading, or infringing on any third party’s rights.‎

When submitting a claim online, you may be redirected to a third-party website. Physicians Insurance does ‎‎not control any third-party website, and these Terms of Use do not apply to your use of any ‎‎third-party website. Please be sure to read the terms of use of any third-party website you visit.‎

  1. ONLINE BILL PAY

Information about our Personal Information Processing Activities

Personal Information is retained based on internal retention policies, which typically requires retention for a period of seven years. Information is segregated by legal retention requirements and maintained in accordance with various local, state, federal, and other legal requirements. Personal information will not be retained beyond the reasonably foreseen need to retain the information for legal or business purposes.

We do not sell consumers' Personal Information.

We do not share Personal Information (for purposes of cross-context behavioral advertising).

We do not sell or share (for purposes of cross-context behavioral advertising) the personal information of minors under 16 years of age.

We share cookies with third parties as described in our online privacy policy. To opt-out of the sharing of information with third parties in this context, please review our online privacy policy for instructions or adjust your browser settings accordingly.

We do not use or disclose Sensitive Personal Information for purposes other than the following:

  1. To perform the services or provide the goods reasonably expected by an average consumer who requests those goods or services.
  2. To prevent, detect, and investigate security incidents that compromise the availability, authenticity, integrity, or confidentiality of stored or transmitted personal information.
  3. To resist malicious, deceptive, fraudulent, or illegal actions directed at the business and to prosecute those responsible for those actions.

Your Privacy Rights

Submitting Consumer Requests

You may submit a consumer request to us by email at [email protected], or by phone at (800) 962-1399 (toll free) to make a consumer request. You may make up to two disclosure requests in any 12 month period.

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

Making a verifiable consumer request does not require you to create an account with us.

When you submit a verifiable consumer request, we will take steps to verify your request by email or telephone call. In some cases, we may request additional information in order to verify your request or where necessary to process your request. If we are unable to adequately verify a request, we will notify the requestor. Authorized agents will be required to provide proof of their authorization and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent.

We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Right to Know and Access Your Information

You have the right to request that we disclose to you certain descriptions and categories of the personal information we collect, use, disclose, share, or sell about you. For example, you may request the following through a consumer request:

  1. The categories of personal information we have collected about you.
  2. The categories of sources from which the personal information is collected.
  3. The business or commercial purpose for collecting, selling, or sharing personal information.
  4. The categories of third parties to whom we disclose the personal information.
  5. The specific pieces of personal information we have collected about you.

Right to Request Deletion

You have the right to request that we delete your personal information. See above for additional details about how to submit a consumer request.

You should be aware, however, that California law allows us to retain your personal information under certain conditions, even if you have asked us to delete it, such as when retaining your personal information is necessary for us to complete a transaction with you or provide you with a good or service you have requested. We will notify you of any denial of your deletion request and the reason for such denial.

Right to Non-Discrimination for Exercise of Consumer Privacy Rights

We will not discriminate against you because you have chosen to exercise any of your privacy rights provided by the CCPA.

Right to Opt-Out of the Sharing or Sale of Personal Information

We may share personal information we collect about you with third parties for purposes of cross-context behavioral advertising. We do not sell personal information we collect about you, as the term "Sale" is defined by the CCPA. You may opt out of the sharing (for purposes of cross-context behavioral advertising) of your personal information by signaling an opt-out preference by making an opt-out request.

To submit a request under the Right to Opt-Out, please provide the information necessary to identify the consumer to whom the request should be applied and reasonable identifying information that you are authorized to make the request and submit an email requesting your "Right to Opt-Out" to [email protected], or by phone at (800) 962-1399 (toll free).

Once you make an opt-out request, we will wait at least twelve (12) months before asking you to reauthorize personal information sales. However, you may change your mind and opt back in to personal information sharing or sale at any time by contacting us.

Authorized agents will be required to provide proof of their authorization to submit opt-out requests and we may also require that the relevant consumer directly verify their identity and the authority of the authorized agent in limited circumstances.

Using an Authorized Agent

You may use an authorized agent to submit a consumer request. To use an authorized agent, you will need to (i) provide written instruction to your agent, and verify your identity to us, or (ii) provide a power of attorney pursuant to California Probate Code Sections 4000 to 4465.
